Frequently Asked Questions

My loved one has lost the mental capacity to make their own decisions.  I want to be appointed their power of attorney.  Can you do this? 

Take your loved one to see their GP.  The GP will decide whether the person is able to make a decision about appointing you as their attorney.  If the doctor says “Yes”, get their opinion in writing, make an appointment to see us and bring the person in to give us their instructions.  If the doctor says that your loved can no longer make this decision, you can apply to the Family Court for an Order appointing you as the persons Welfare Guardian and Property Manager.  Make an appointment for you to talk to us about this process.

Do you take legal aid clients? 

Yes.  We accept legal aid clients for criminal and all family court matters (except relationship property disputes).

How do I apply for legal aid? 

We will assist you to complete an application for legal aid if your case is a Family Court one.  Please make an appointment and bring proof of your income, Eg: your latest wage slip or a benefit break down letter from WINZ. See the duty lawyer at court if you want legal aid for Police or Probation charges.  They will fill in the application form with you.

Where is your office?

Our office is at the southern end of Main Street, Huntly – across the road from the Essex Arms.  There is free public parking besides the Essex Arms or on Vienna Fry Lane.

Do you have disability access to your office?

Yes.  We can arrange a special downstairs appointment if you are unable to climb the stairs to our first-floor office.  Just let us know when you call to make an appointment.

Do you make home visits?

We can make house and care home visits to clients with special mobility restrictions.  This service does come with an additional fee.  Please call to discuss your needs.
